When a foreign national dies as an Italian resident, their estate is governed by a complex framework of <strong data-start=\"908\" data-end=\"937\">international private law<\/strong>, <strong data-start=\"939\" data-end=\"967\">Italian succession rules<\/strong>, and <strong data-start=\"973\" data-end=\"1005\">cross-border tax regulations<\/strong>.<\/p>\n<p data-start=\"1010\" data-end=\"1396\">Understanding how these systems interact is essential to ensure that one&rsquo;s estate plan reflects personal wishes while remaining compliant with applicable laws. Three key aspects require particular attention: the <strong data-start=\"1222\" data-end=\"1241\">professio iuris<\/strong> (choice of law), the <strong data-start=\"1263\" data-end=\"1300\">Italian regime of forced heirship<\/strong>, and the <strong data-start=\"1310\" data-end=\"1355\">coordination of inheritance and tax rules<\/strong> between Italy and other jurisdictions.<\/p>\n<hr data-start=\"1398\" data-end=\"1401\">\n<h2 data-start=\"1403\" data-end=\"1464\"><strong data-start=\"1406\" data-end=\"1464\">1. This concept looks beyond formal registration and focuses on the place where the individual&rsquo;s personal and economic life was genuinely centred.<\/p>\n<p data-start=\"2132\" data-end=\"2334\">As a result, when a foreign national becomes habitually resident in Italy, <strong data-start=\"2207\" data-end=\"2233\">Italian succession law<\/strong> will typically govern the entire estate by default&mdash;even if the person retains foreign citizenship.<\/p>\n<p data-start=\"2336\" data-end=\"2500\">However, the Regulation provides significant flexibility through an exception that allows a person to elect the law of their nationality: the <strong data-start=\"2478\" data-end=\"2497\">professio iuris<\/strong>.<\/p>\n<hr data-start=\"2502\" data-end=\"2505\">\n<h2 data-start=\"2507\" data-end=\"2575\"><strong data-start=\"2510\" data-end=\"2575\">2. By making a valid <em data-start=\"3083\" data-end=\"3100\">professio iuris<\/em>, a foreign national residing in Italy can align their estate plan with the legal traditions and principles of their home country.<\/p>\n<p data-start=\"3234\" data-end=\"3533\">To be valid, the choice of law must be <strong data-start=\"3273\" data-end=\"3300\">express and unequivocal<\/strong>, typically through a clause in the will stating that the estate shall be governed by &ldquo;the law of [country of nationality].&rdquo; Once made, the choice applies to <strong data-start=\"3458\" data-end=\"3479\">the entire estate<\/strong>, regardless of where individual assets are located.<\/p>\n<p data-start=\"3535\" data-end=\"3829\">It is important to note that while the professio iuris determines <strong data-start=\"3601\" data-end=\"3649\">which substantive law governs the succession<\/strong>, certain <strong data-start=\"3659\" data-end=\"3696\">formal or procedural requirements<\/strong> under Italian law&mdash;such as the publication of the will or the transfer of title to Italian real estate&mdash;must still be complied with.<\/p>\n<p data-start=\"3831\" data-end=\"4095\">In essence, the professio iuris is a powerful planning tool that allows international residents in Italy to achieve <strong data-start=\"3947\" data-end=\"3989\">unity, predictability, and flexibility<\/strong> in their succession, often avoiding conflicts between jurisdictions and potential disputes among heirs.<\/p>\n<hr data-start=\"4097\" data-end=\"4100\">\n<h2 data-start=\"4102\" data-end=\"4165\"><strong data-start=\"4105\" data-end=\"4165\">3. If the heir accepts, they cannot later contest the will or claim further rights. This technique often simplifies administration and avoids situations of joint ownership among heirs, especially in cases involving the family home.<\/p>\n<p data-start=\"6086\" data-end=\"6456\">Finally, while the law provides mechanisms for heirs to contest the will, in practice the action for reduction is complex and often unsuccessful unless a clear and demonstrable violation exists. The burden of proof lies with the claimant, and courts tend to prioritize solutions that preserve the stability of the succession rather than undoing its structure entirely.<\/p>\n<hr data-start=\"6458\" data-end=\"6461\">\n<h2 data-start=\"6463\" data-end=\"6509\"><strong data-start=\"6466\" data-end=\"6509\">4.
