Consultation, full case management and legal protection in case of delays or denials.

Italian citizenship opens rights, stability and new opportunities in Italy and across the European Union. But the process can turn into an obstacle course: foreign records to legalize, genealogical reconstruction, certified translations, consulate backlogs and, since 2025, new eligibility limits for citizenship by descent.

If you have Italian roots in the United States, Canada or Latin America, the lawyers of OS Law guide you end to end, entirely in English and entirely remotely: we verify your eligibility, choose the correct path (consulate, municipality or court), reconstruct and legalize your documents, file and follow the case, and litigate in Italy to protect your rights when needed.

Our goal is simple: avoid the mistakes that trigger requests for further documents and delays, increase your chances of a positive outcome and act immediately when the authorities fail to decide within reasonable time or issue an unlawful decision.

Who can apply for Italian citizenship?

Identifying the correct path and building a consistent dossier is often the difference between a smooth process and years of blocks or document requests, especially after the 2025 reform.

Citizenship by descent (jure sanguinis)

If you have Italian ancestors, you may be entitled to recognition of Italian citizenship. Success depends on genealogical reconstruction and the consistency of certificates (names, dates, places), as well as handling any critical issues (spelling variations, transcriptions, the ancestor’s naturalization date). This is the most common path for clients in the U.S., Canada and Latin America.
2025 reform: the new generational limit

Since Law no. 74/2025 (which converted Decree-Law 36/2025), recognition by descent generally requires a parent or grandparent born in Italy. Those who had already filed an application, booked a consular appointment or started court proceedings by 27 March 2025 are assessed under the previous, more generous rules. A preliminary legal review tells you exactly which framework applies to you.
Court applications & 1948 cases (judicial route)

When the consular route is blocked, delayed, or your line passes through a female ancestor before 1 January 1948, recognition can be pursued before the competent Italian court. We assess eligibility and handle the proceedings directly in Italy on your behalf.
Citizenship by marriage

The foreign spouse of an Italian citizen can apply once the legal requirements are met, including Italian language (B1) and the continued existence of the marriage. These cases often require careful handling of foreign documents and personal-data consistency.
Citizenship by residence (naturalization)

For those who live in Italy and have met the required conditions: legal and continuous residence, adequate income, Italian language (B1) and no disqualifying grounds. Rigorous document preparation reduces suspensions and requests for further documents.
Reacquisition & other cases

Further routes exist (reacquisition for those whose line lost citizenship, adoption, special cases). In these scenarios an initial legal assessment is essential to set the correct strategy.

How we work
A clear method, a case managed end to end

separator-custom-icon Italian Citizenship

Step 1 - Assessment & strategy

We analyze your eligibility and any critical points, confirm whether you qualify under the 2025 rules, identify the correct channel (descent, marriage, residence, court) and define a clear roadmap of documents and actions.

Step 2 - Document & genealogy dossier

We manage the checklist and the retrieval of Italian and foreign records, including apostille/legalization and certified translations. We verify the consistency of names, dates and places to prevent procedural blocks.

Step 3 - Filing, monitoring & document requests

Full support through the application (consulate, municipality or court), document upload, dossier organization, handling of requests for further documents and monitoring until the outcome.

Step 4 - Outcome & final formalities

If your case is approved, we assist you through to the end, including the final formalities and the registration of your records.

Step 5 - Delays & legal protection

If your case has been stuck for too long, we act with formal reminders, notices and access to the file. When necessary, we prepare and pursue court proceedings to protect your rights.

Step 6 - Denial & appeal

In case of denial, we analyze the reasons and the file and assess the most effective strategy, including an appeal to the Administrative Court (TAR) where there are flaws in the reasoning or shortcomings in the procedure.

Is your application stuck for months at the consulate, or have you received a denial? Don’t wait: the right legal strategy makes the difference, formal reminder, notice of default, access to the file and reconstruction of the procedure.

When it is the right move, we prepare and pursue court proceedings in Italy to challenge flawed reasoning, procedural shortcomings or disproportionate decisions.

Before taking costly action or steps with low chances of success, we always give you a realistic preliminary assessment of your actual prospects, and we tell you honestly whether it is worth proceeding.

Frequently asked questions

Quick answers to the most common questions about eligibility, timelines and protection in case of delays or denials.

Can I still get citizenship by descent after the 2025 changes?

It depends on your lineage. Since Law 74/2025, recognition by descent generally requires a parent or grandparent born in Italy; those who started the process by 27 March 2025 are assessed under the previous rules. A preliminary review tells you exactly where you stand.
Do I need to travel to Italy?

In most cases, no. We handle the process remotely and represent you in Italy for record retrieval, filings and court proceedings, communicating with you entirely in English.
Can I keep my current citizenship (U.S., Canadian, etc.)?

In many cases yes. Most countries, including the U.S., Canada, Brazil and Argentina, allow dual citizenship, but it also depends on your country’s rules. We check the practical impact for your situation.
How much does legal assistance cost?

The quote depends on the path and the complexity of the case. That is why we start with a preliminary assessment: we set out the activities, timelines and costs transparently, before any commitment.
How long does it take?

It depends on the path (descent, court, marriage, residence) and on how complete your documents are. A consistent dossier reduces suspensions and requests for further documents. During the consultation we give you a realistic estimate for your case.
What if my application is stuck or was denied?

We can act with formal reminders, notice of default, access to the file and, if necessary, court proceedings in Italy to obtain a decision or challenge a denial.
Do you assist clients living abroad?

Yes. We assist clients in the U.S., Canada, Latin America and elsewhere, with full English-language communication and coordinated legal and operational handling, entirely remote.
